HHS Issues Final Rules for Health Insurance Exchanges

Today, the Department for Health and Human Services issued the Final Blueprint for health insurance exchanges, a key provision of the Affordable Care Act. The Final Blueprint (45 pp.) lays out state requirements for state based exchanges and state partnership exchanges where states work in conjunction with the federal government. The blueprints are due to HHS by November 16, 2012, in order for states to meet the January 1, 2013, certification date set out in the federal law. The federal government will establish and operate insurance exchanges in states that do not seek to establish state based exchanges or state partnership exchanges.

Grant funding under Section 1311(a) of the Affordable Care Act continues to be available to states through 2014 for state-based exchanges, state partnership exchanges, and states that are building linkages to the federally-facilitated exchange.
