In early October, a facility in the province of Saskatchewan became the first commercial-scale coal-fired plant with carbon capture and storage capability in the world. The Boundary Dam Power Station is run by SaskPower, a crown corporation — meaning it is owned by the provincial government but operates like a private company. The plant uses clean coal technology to prevent most of its carbon dioxide and sulfur dioxide emissions from being released into the atmosphere

According to several news accounts, the EPA is expected to release an updated rule - perhaps by next Friday - that would tighten greenhouse gas emissions from new fossil fuel power plants. Several states in the Midwest are now involved in carbon-capture-and-storage projects. 

The SSL Committee published a draft of Wyoming Chapter 30 of 2008 about Carbon Sequestration in the 2010 SSL Volume. This draft Act expands upon the Wyoming legislation by including eminent domain provisions about construction and operation of such a facility, including installation of pipelines to transport carbon dioxide. This Act also addresses long term liability by transferring ownership of such facilities to the state 10 years (or other time period adopted by rule) after a facility closes. Finally, the Act establishes a Carbon Dioxide Geologic Storage Trust Fund, funded by fees and penalties, to provide for long-term operation and maintenance of facilities.

Though I predict climate change legislation will not pass in 2010, it will come to pass, most likely beginning with a utility sector cap.  Thus, it is essential to advance the development and deployment of carbon capture and storage (CCS) in order to curb coal-fired power plant emissions.
